Terms of Service

Farmers Mate

These Terms form a legal agreement between you and the sole trader operating under the registered business name Faraway Ventures. They govern your access to Farmers Mate, including offline storage, cloud synchronisation, farm collaboration and future paid features.

1. Acceptance of these Terms

By downloading, accessing, creating an account for, or using Farmers Mate (the “App”), you agree to these Terms of Service (“Terms”) and the Farmers Mate Privacy Policy. If you do not agree, do not use the App.

In these Terms, “Faraway Ventures”, “we”, “us” and “our” refer to the sole trader operating under the registered business name Faraway Ventures. “You” means the individual using the App and, where applicable, the business, farm or organisation on whose behalf that individual acts.

If you use Farmers Mate for a business, partnership, company, trust, farm or other organisation, you confirm that you have authority to bind that entity to these Terms.

2. Eligibility and accounts

There is no fixed minimum age for Farmers Mate. You must have sufficient legal capacity and understanding to agree to these Terms and use the App appropriately. If you do not have that capacity, or if applicable law requires it, you may use Farmers Mate only with the consent or authority of a parent, guardian or other person legally authorised to act for you. A Farm Owner or other authorised person who invites or permits a young person to access a Farm is responsible for ensuring that access is appropriate and authorised. You must provide accurate account information and keep it current.

  • Keep your password, device and email account secure.
  • Do not share an account between people. Each user should use their own account.
  • Tell us promptly if you suspect unauthorised access or a compromised account.
  • Accept responsibility for activity performed through your account unless caused by our breach of law or failure to use reasonable care.

We may require email verification, password re-authentication, device authentication or other reasonable verification for account recovery, changes to security details, ownership transfer, deletion, restore or other sensitive actions.

3. What Farmers Mate provides

Farmers Mate is an offline-first farm management and record-keeping application. Current and evolving features may include farm, team, livestock, animal health, breeding, movement, paddock, property, rainfall, equipment, servicing, parts, reminders, backup, restore, synchronisation and related tools. Customer-facing export/download functionality may be introduced in a future release but is not currently available.

Some features operate locally on your device. Other features require an account, internet connection, cloud service, compatible device, operating-system permission, subscription, or particular farm role. Features may differ by platform, location, plan, release stage or device capability.

4. Important agricultural and professional-use disclaimer

Farmers Mate is a record-keeping and farm management tool. It is not a substitute for veterinary, animal-health, agronomic, chemical, medication, financial, accounting, legal, regulatory, safety, engineering or other professional advice.

You remain responsible for checking information before making decisions, including livestock treatment or dosage decisions, withholding periods, chemical use, machinery operation or servicing, paddock management, financial calculations, legal compliance and workplace safety.

Calculators, reminders, forecasts, summaries, suggested dates, alerts and generated outputs may rely on information you enter, device settings, assumptions or third-party data. They may be incomplete, delayed or incorrect. Verify critical information against labels, manufacturer instructions, professional advice, legislation, official records and conditions on the farm.

Do not use Farmers Mate as the only system for emergency response, life-critical monitoring, animal welfare intervention, regulated records, safety shutdowns or any purpose where a delay, error or unavailable device could cause death, personal injury, animal harm, environmental harm or significant property loss.

5. Farm creation, ownership and authority

For these Terms: an “Account” is an individual user's Farmers Mate login; a “Farm” is the shared workspace and record set administered through Farmers Mate; “Farm Data” is the operational content and records associated with that Farm; and a “Farm Member” is an Account authorised to access that Farm.

The person who creates or is assigned ownership of a farm in Farmers Mate may receive the “Owner” role. App ownership is an access-control role and does not determine legal ownership of land, animals, equipment, records, businesses or intellectual property.

A farm owner must have authority to create the farm, upload its information, invite users, assign roles, and make decisions affecting shared data. If ownership is disputed, we may require reasonable evidence, suspend changes, restrict access or direct the parties to resolve the dispute outside Farmers Mate.

6. Team members, roles and shared records

Farmers Mate uses Farm roles including Owner, Manager, User and View Only. The Owner has top-level administrative authority within the App, including ownership transfer and Farm-level settings. Managers, Users and View Only members receive progressively more limited permissions according to the role model presented in the App. Authorised roles may invite users, manage access or change records only where their assigned permissions allow. Permissions cannot prevent every mistake, misuse, screenshot or offline copy.

  • Only invite people who are authorised to access the farm’s information.
  • Review team access regularly and remove people who no longer need access.
  • Use appropriate roles and do not deliberately bypass access restrictions.
  • Understand that authorised changes may synchronise to every connected user and device.
  • Resolve internal employment, contractor, family, partnership or ownership disputes independently of Farmers Mate.

We are not a party to arrangements between farm owners and team members and are not responsible for how an authorised user uses information they lawfully accessed or exported, except to the extent required by law.

7. Your data and content

7.1 Ownership

Farm records and operational content created for a Farm (“Farm Data”) remain associated with that Farm regardless of which authorised Farm Member created or edited them. As between Faraway Ventures and the person or entity with the underlying legal rights to that Farm Data, those rights remain with that person or entity; they are not transferred to Faraway Ventures. The Farmers Mate Owner role gives administrative authority within the App but does not by itself determine legal ownership of land, livestock, equipment, a business, intellectual property or personal information.

7.2 Licence needed to provide the App

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, format, process, back up, restore, display and otherwise use Farm Data and other content you are authorised to provide only as reasonably necessary to provide, secure, support and improve Farmers Mate, comply with law, and exercise our rights under these Terms. This licence ends when the content is deleted from our active systems, subject to backups, logs, legal retention and technical processing periods.

7.3 Your responsibilities

You are responsible for content you provide or manage through Farmers Mate and must ensure that:

  • It is accurate enough for your intended use and is kept appropriately up to date.
  • You have all rights, consents and authority needed to enter, upload, share, export and process it.
  • It does not unlawfully disclose personal, confidential, proprietary or sensitive information.
  • It does not infringe intellectual property, privacy, confidentiality, employment or other rights.
  • You maintain any separate records, backups or retention required by law, contracts, insurers, regulators or good farming practice.

8. Offline use, synchronisation and backups

Farmers Mate is designed to allow local use without continuous connectivity, but offline operation creates risks. Changes may remain only on a device until synchronised. Multiple users or devices may edit related records before receiving each other’s updates. Connectivity, device clocks, permissions, storage limits, software defects or conflicts may delay or affect synchronisation.

  • Check important records after reconnecting, restoring, switching devices or resolving conflicts.
  • Do not uninstall the App, clear local data, discard a device or rely on a reset until important pending changes are confirmed as synchronised or separately backed up.
  • Maintain independent copies of critical, regulated or irreplaceable records.
  • Understand that a backup or restore may not contain changes made after the backup date or changes that never reached the backup service.

We will use reasonable care in designing synchronisation and backup functions but do not guarantee that every local change will upload, every conflict will be resolved as you expect, or every deleted record can be recovered.

9. Acceptable use

You must not, and must not help another person to:

  • Use Farmers Mate unlawfully, fraudulently, deceptively or in a way that harms people, animals, property, systems or the environment.
  • Access a farm, account, record or system without authorisation or exceed an assigned role.
  • Probe, scan, bypass or interfere with security, authentication, permissions, rate limits, synchronisation, networks or infrastructure.
  • Upload malware, malicious code, unlawful content, or material that infringes another person’s rights.
  • Scrape, harvest, sell or commercially exploit user information or the service without written permission.
  • Reverse engineer, decompile, disassemble, copy or create derivative works from the App except where applicable law does not allow that restriction.
  • Use the App to build or train a competing product through automated extraction or systematic replication.
  • Misrepresent identity, authority, ownership, affiliation, qualifications or the source of information.
  • Abuse support channels, make knowingly false reports, or impose unreasonable load on the service.

10. Intellectual property

Farmers Mate, its software, interface, design, branding, documentation, databases, templates and other materials supplied by us are owned by or licensed to Faraway Ventures and are protected by intellectual-property laws. Except for the limited right to use the App under these Terms, no rights are transferred to you.

“Farmers Mate” is the name used for the App. Registration status may change. You must not use our names, logos, designs or branding in a way that suggests endorsement or affiliation without permission.

Feedback you voluntarily provide may be used by us without restriction or payment, provided we do not publicly identify you without permission.

11. Third-party services and app stores

Farmers Mate relies on third-party platforms and services, which may include Apple, Google, Firebase, device operating systems, notification services, hosting providers and payment processors. Their terms and privacy policies also apply to your use of their services.

Third-party services may be unavailable, changed or discontinued outside our control. We are not responsible for third-party products or content, but this does not exclude any responsibility that cannot lawfully be excluded.

12. Paid plans, subscriptions and purchases

Farmers Mate may introduce paid plans, subscriptions, in-app purchases or paid features. No charge applies unless a price and purchase process are presented to you and you choose to purchase.

  • Prices, included features, billing period and applicable taxes will be shown before purchase.
  • App-store purchases are billed and managed by the relevant app store under its terms.
  • Subscriptions may renew automatically unless cancelled through the applicable store or billing provider before renewal.
  • Deleting the App or an account may not automatically cancel an external subscription. You must cancel through the billing provider where required.
  • Refunds are handled under applicable law and the rules of the store or payment provider.
  • We may change future pricing or plan inclusions with notice required by law, but changes will not retrospectively alter a completed one-off purchase.

13. Changes to Farmers Mate

We may add, remove, replace or modify features; release updates; change compatibility; impose reasonable usage or storage limits; or discontinue part of the App. We will use reasonable efforts to give appropriate notice of material changes where practical, particularly where a change affects paid features or access to stored data.

You may need to install updates to continue using online services or maintain security and compatibility. We are not obliged to support every device, operating-system version or legacy feature indefinitely.

14. Availability and support

We aim to provide a reliable service but do not promise uninterrupted, error-free or always-available access. Availability may be affected by maintenance, internet or power outages, device conditions, app-store processes, cloud-provider incidents, force majeure, security events, legal requirements and other circumstances outside reasonable control.

Support may be provided through the contact details in these Terms. Response times, support hours and supported features may vary. Unless expressly included in a paid plan, no service level agreement applies.

15. Deleting data, farms and accounts

15.1 Account deletion

You may delete or request deletion of your personal Account where supported. We may require verification. Account deletion is separate from Farm deletion: Farm Data does not automatically disappear merely because the member who created or edited a record later leaves or deletes their Account. An Owner must transfer ownership or choose to delete the entire Farm before deleting only their Account.

15.2 Entire-farm deletion

A Farm Owner may delete the entire Farm and its shared Farm Data where that function is available. Doing so is intended to permanently remove the Farm and access for every Farm Member. It may be irreversible and may require device authentication, Firebase re-authentication, typed or repeated confirmation, or other stronger verification. The Owner is responsible for ensuring they have authority to delete the shared Farm Data and for notifying affected users where appropriate.

15.3 Processing period

Deletion may take time to propagate across devices, offline queues, caches, backups and service providers. Limited records may be retained where required by law, security, fraud prevention, dispute resolution or technical backup cycles. Farmers Mate does not currently provide a general customer-facing export/download feature. If export functionality is introduced later, copies exported outside Farmers Mate will not automatically be deleted from the recipient's storage.

16. Suspension and termination

You may stop using Farmers Mate at any time. We may suspend or terminate access, remove content, restrict a feature or take protective action where reasonably necessary to:

  • Address a serious or repeated breach of these Terms.
  • Protect users, animals, property, systems, data or the public.
  • Respond to suspected fraud, unauthorised access, security compromise or unlawful activity.
  • Comply with law, court order, regulator request or app-store requirement.
  • Manage non-payment for a paid service after reasonable notice.
  • Discontinue the service or a material part of it.

Where appropriate and lawful, we will give notice and a reasonable opportunity to correct the issue and, where an export function is available, retrieve relevant data. Immediate action may be taken for urgent security, safety or legal reasons.

17. Consumer guarantees and warranties

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Subject to those non-excludable rights, Farmers Mate is provided on an “as available” basis. We do not warrant that the App will be uninterrupted, completely secure, error-free, compatible with every device, suitable for every farm, or that every calculation, alert, synchronisation, backup, restore or third-party data source will be accurate or complete.

18. Limitation of liability

To the maximum extent permitted by law, Faraway Ventures is not liable for indirect, incidental, special or consequential loss; loss of profit, revenue, opportunity, goodwill or anticipated savings; loss, corruption or unavailability of data; or loss arising from reliance on unverified records, calculations, reminders, third-party data or professional-use decisions.

Where liability for a failure to comply with a non-excludable guarantee can lawfully be limited, our liability is limited, at our option, to supplying the relevant services again or paying the reasonable cost of having them supplied again.

To the maximum extent permitted by law, our aggregate liability arising from Farmers Mate or these Terms is limited to the greater of: (a) the amount you paid us for Farmers Mate during the 12 months before the event giving rise to the claim; and (b) AUD $100. This cap does not apply where it would be unlawful, including liability that cannot be limited under the Australian Consumer Law.

19. Indemnity

To the extent permitted by law, you indemnify Faraway Ventures against third-party claims, losses and reasonable costs arising from your unlawful use of Farmers Mate, your breach of these Terms, content you provide or manage through Farmers Mate, your unauthorised access or invitations, or your infringement of another person’s rights. This indemnity does not apply to the extent the loss was caused by our negligence, unlawful conduct or breach of these Terms.

20. Disputes

Before starting court proceedings, you and Faraway Ventures should first try in good faith to resolve the dispute by written notice and reasonable discussion. This does not prevent either party from seeking urgent injunctive relief, using an applicable consumer tribunal, or exercising rights that cannot be restricted.

21. Governing law

These Terms are governed by the laws of Queensland, Australia. Subject to any non-excludable right to bring a claim elsewhere, the parties submit to the courts of Queensland and courts entitled to hear appeals from them.

22. Changes to these Terms

We may update these Terms to reflect changes to Farmers Mate, legal requirements, security practices, service providers or business models. We will publish the updated Terms with a new effective date and give additional notice where required. If a material change requires consent, we may ask you to accept the updated Terms before continuing to use affected features.

23. General

  • If part of these Terms is invalid or unenforceable, the remaining parts continue to apply.
  • A failure to enforce a right is not a waiver of that right.
  • You may not transfer your rights or obligations under these Terms without our consent, except where law permits. We may transfer these Terms as part of a genuine business restructure, sale or transfer, subject to applicable law.
  • These Terms, the Privacy Policy, any applicable purchase terms and any expressly incorporated notices form the agreement about Farmers Mate. They do not exclude rights that cannot lawfully be excluded.
  • Headings are for convenience and do not affect interpretation.
